Enactment of the agreement-

You acknowledge that you have read and understand the following Terms and Conditions (collectively the "Terms"), including these Terms, terms of our Privacy Policy available at easyshopy.com, by entering, connecting, using or creating an account on this website and its associated applications on iPhone, iPad, Android, and any mobile application (hereinafter collectively referred to as the "Platform"), including without limitation any services offered on the Platform. You agree that between you and Box Easyshopy Portal L.L.C, these Terms are a valid, enforceable contract (hereinafter referred to as "Easyshopy", "Company", "we", "us", "our") regarding the use of this Platform. Please read these terms before ordering any items from our application.

You become a user of the Platform ("User" or "you"), by entering, using, browsing or registering on the Platform. As a User, you agree and undertake to comply with the provisions of these Terms.

You are in charge of making any preparations required for your access to the Platform. Additionally, you must make sure that these Terms are understood and followed by anybody who uses your Internet connection to use the Platform. You accept these Terms as a binding contract without restriction or qualification by accessing, using, browsing, or contributing any content or material on the Platform. Anyone who views, uses, accesses, browses, or publishes any content or material to the Platform is referred to as "you" or "You."

If you do not agree to these Terms, then you may not use the Platform. Easyshopy reserves the right to modify these Terms at any time without prior notice. You agree that each visit you make to the Platform shall be subject to the Terms as displayed, and your continued use of the Platform now or following the modifications in these Terms confirms that you have read, accepted, and agreed to be bound by such modifications.

Easyshopy Platform (services)-

The Platform enables its users who accept the terms to place orders from associated or third-party operated restaurants, merchants, grocery stores, etc (hereinafter referred to as the "Merchants").

This platform's goal is to make it easy and quick for users to order a variety of products, such as prepared foods, beverages, non-cooked foods, and other non-food items, from local merchants for delivery (our "Service") (hereinafter collectively referred to as "Goods"). Some of the goods on our platform, including but not limited to pharmaceuticals, may have restrictions on their purchase (referred to as "Restricted Goods").

Users may build and submit orders with the push of a button thanks to interactive features. To complete your order from the Platform and to oversee your experience during the order processing, Easyshopy serves as a facilitator on behalf of the Merchant when you make an order with them. The Platform was developed to act as a marketplace for its users.

Any products or services created by the Merchants are not sold by Easyshopy, nor is Easyshopy in any way involved in their creation. The Users of this online market have the option to look for and locate nearby Merchants who transport or make these goods available to their addresses and allow them to place orders through this Platform.

Users should be aware that Easyshopy does not in any way independently vouch for a merchant's qualifications, claims, or goods, for the quality or composition of any products, or for whether a merchant is in accordance with legal requirements. Users must feel at ease by obtaining information from Merchants on the Platform or directly from the Merchants that pertains to the Merchants' caliber and dependability as well as their compliance with relevant regulations.

We reserve the right but are under no obligation, to restrict or limit the sales of our Goods to any individual, group of people, or area of the world.

Due to the laws in some countries, we shall not offer for sale certain goods or restricted items to you. Any offer for any Goods made on the Platform is void when it is prohibited by law.

The quality of any Goods or their compliance with applicable laws are not in any way guaranteed by Easyshopy, and neither is the accuracy of the list of Goods listed on the Platform concerning what is given to Users. Additionally, a Merchant may claim that the production of products and services complies with special standards, such as (but not limited to) "organic," "macrobiotic," or allergen-specific requirements, such as (but not limited to) "nut-free," "gluten-free," or "lactose-free." Easyshopy is not required to list allergies or ingredient information on the Platform, nevertheless. Unless otherwise required by applicable regulations, Easyshopy does not guarantee that the goods sold by merchants are free of allergies.

If you have allergies, allergic reactions or dietary restrictions and requirements, please contact the Merchant before placing an Order on our Platform. as Easyshopy does not independently investigate or verify such representations.

Easyshopy and the Merchants (as applicable) will make a reasonable effort to follow any special instructions you provide with an Order. However, Easyshopy and/or the Merchants reserve the right to proceed to produce the Order following ordinary operating procedures in some circumstances when this is not practical, possible, or commercially justifiable. If an Order does not follow any special instructions you offer, neither Easyshopy nor the Merchants shall be obligated to replace or refund the Order.

Easyshopy disclaims all liability and responsibility for any products or services provided by Merchants that are harmful, cause harm, are otherwise intolerable to Users, or in any other way fail to live up to their expectations.

Easyshopy shall have no liability or obligation for any such incorrect addresses; it is exclusively the duty of users to confirm the accuracy of delivery addresses. The merchant that accepts the order is solely responsible for all deliveries and preparations of the goods and services. Please be aware that although the Merchant will make every effort to fulfill the indicated delivery time, delivery times may be impacted by events outside of their control and hence cannot be guaranteed. We will inform you if we become aware of an unexpected delay.

Creating an Account for the platform-

A User can register for an account on the Platform and choose their own "user name" and "password," both of which are up to them. The "user name" is unique to the User and is not issued to two different Users at the same time. Only the user knows the "password." Anytime the user wants, they can modify their password. The user is solely responsible for choosing and safeguarding the password. Easyshopy disclaims all responsibility for any issues that may develop as a result of password use. Easyshopy emails the user with information on promotions that are happening nearby that the user may find useful.

Easyshopy may share your username and password with third-party companies to provide our Service – for example, the phone number may be shared with the Merchant which deals with take-out goods and services, to provide faster and correct delivery. For the user to connect to the services, which require an Account of the Platform, the user must enter the username and password. This process is called "login" to the Platform.

By using this Platform, you represent and warrant that all personal information you provide to us is true, accurate, current, and complete in all respects. You also agree not to impersonate another person or organization, use a false name, or a name that you are not authorized to use and to immediately notify us of any changes to your personal information by updating your user profile on the Platform or by contacting us.

Multiple Accounts cannot be registered for the same user to utilize. Your account could be terminated for violating this provision. Passwords for users should never be shared or made public and should always be kept private.

You are responsible for all activities and orders that occur or are submitted through your Account. If you know or suspect that someone knows your password, then you should contact us immediately.

You are not allowed to use the Platform for any improper or prohibited activities, including but not limited to:

Disseminating any content that is illegal, defamatory, abusive, threatening, hurtful, vulgar, or otherwise undesirable transmitting content that violates any laws, rules, or codes of conduct, is illegal, subject to civil punishment, or both.

preventing anyone else from using or enjoying the Platform.

Attempting to use hacking, spoofing, or other similar techniques to gain unauthorized access to this Platform or networks linked to it, or to damage, disable, or impair its functionality.

We expect a device to hold one User account only. We may allow service in such cases but we will not allow the use of promotions.

If you wish to delete your Account, please contact us via social media or call us.

How to make an order and how it works-

You will have the option to submit your order by clicking the "Checkout" button after choosing your goods from the merchant's list (the "Order"). Please take note that once you click the "Checkout" button, errors cannot be corrected, thus it is crucial to double-check your entry and make any necessary corrections before clicking. The Platform will start processing your order as soon as it receives it, and we'll notify you through email and a note on the checkout page that your order has been successfully delivered to the Merchant.

Order Cancellation-

You can cancel an order for a full refund until the order has been accepted by the Merchant. If you need to cancel the order after it has been accepted by the Merchant, please contact us via the chat function on the Platform to cancel the order. Easyshopy reserves the right to not issue full or partial refunds if you have canceled the order after it has been accepted.

An order may be subsequently canceled by a Merchant after you have received a confirmation that it has been sent to the Merchant. Easyshopy and our partner Merchants reserve the right to cancel any order, before or after acceptance, and will notify you immediately of any such cancellation. Your order history will only hold your successful orders, and in case of failed online payment, the Order amount will be refunded to your Easyshopy account as Easyshopy credit unless you request a refund to the original source of payment account which will take place within 7-14 days as per your bank.

Delivery-

You are aware that different delivery areas may have different product options from Easyshopy. You can see the Vendors we make available to you at that moment by entering your delivery address on the Platform. Delivery zones may fluctuate or enlarge based on a variety of factors, including the weather, traffic, unavoidable circumstances, etc.

Easyshopy will send your order to the delivery address you specify. You will receive an estimated delivery date in your email confirmation and on the order tracking page. However, delivery times will vary based on uncontrollable factors (such as order size, travel distance, time of day (during peak hours), weather, traffic conditions, etc.).

When you click on "My orders" on the Platform, you can see how long delivery will take. You understand that the delivery window we give you is merely a rough estimate, and orders could come in sooner or later. Once an order is placed, you should make sure that either you or someone else is present at the delivery location to accept the Order to avoid missing it.

Failure or Ineffective Deliveries-

Without limiting any other provisions in these Terms, if you are to blame for our inability to deliver an Order for any reason, including but not limited to:

No one was accessible or present to receive the Order; the customer could not be reached despite efforts to do so by calling the number supplied; there was insufficient or improper access to make the Delivery of the Order successful; there was no suitable or secure area to leave the Order.

To let you know about the unsuccessful delivery and the next actions, we will get in touch with you through email, in-app calls or messages. Easyshopy has the right to do this without providing you with a refund or other form of compensation.

No-show cancellation-

Easyshopy retains the right to cancel the Order without providing you with a refund or other kind of compensation if you are no longer reachable or do not receive it within a reasonable amount of time after it arrives at your delivery address.

Incorrect, omitted, and defective items-

If, after receiving your order, you find that there are problems with it (such as a mistaken order, a defective order, or missing items), please get in touch with customer care as soon as possible using our in-app customer support chat option. In certain circumstances, Easyshopy could ask for photographic evidence and/or other details to adequately analyze the problem with your Order. If we find that the Order and/or the goods you received are not in a satisfactory state or of a high enough caliber, we will compensate you for your Order or parts of your Order.

Delivered late-

Please get in touch with customer service right away using our in-app customer support chat function if your Order is considerably delayed relative to the estimated delivery time. In some circumstances, Easyshopy can ask for more details so that it can adequately investigate the problem with your Order. We will reimburse you for your Order if we find that the Order and/or the goods you got were considerably delayed.

Delivery Without Touch-

For certain of the goods available, the consumer may choose contactless delivery as one of the delivery alternatives (the delivery of the Order to the front door of a specified delivery address without face-to-face interaction for instance). If the items are stolen, damaged, contaminated, or otherwise deteriorate after delivery, Easyshopy is not responsible.

Pick-up Services-

Pickup Method-

You will have the choice to "Pick-Up" your Order from the Merchant's location in person rather than having it delivered to You, when available and as noted on the Platform. The "Collection Time" for you to pick up the Order will be stated in your email confirmation. By the Collection Time, the Merchant will have the Order prepared. A reasonable delay may be anticipated in some circumstances. The Merchant undertakes to hold the Order for you at the Merchant's location for no more than a reasonable thirty (30) minutes following the Collection Time ("Holding Time"). If you do not take out your Order within the Holding Time, the Merchant is under no obligation to provide you with the Order.

Possession Liability-

You bear the risk of any damage, loss, loss of quality, or change in the condition of the Goods in the event of unreasonable delays in Pick-Up that are your fault (e.g. changes in the temperature fit for consumption). You will not be eligible for a refund or replacement of the goods in this situation. When you pick up your order, you alone are responsible for evaluating the goods, and you must notify the merchant of any problems or flaws before leaving the merchant's property. The merchant will act as a recipient of messages for Easyshopy.

Your Responsibilities-

When using the Platform's services, the User consents to and agrees to:

The data that has been given to us is accurate. In these situations, the User's Account may be canceled. The User is the only party accountable for any losses that may result from any incorrect or insufficient information (such as forgetting the password).

The User is solely responsible for all personal thoughts, opinions, and statements made by the User while using the Platform's services, as well as all files uploaded to the Platform and any personal information sent therein; the User also agrees not to access any Platform-provided services without authorization or in any manner other than that specified by the Platform;

Easyshopy shall not be liable for any damages that may result from reading user data by any unauthorized individuals, not to send any messages that are threatening, immoral, racially offensive, or otherwise in violation of United Arab Emirates law, not to change the software in any way, not to use the software that is identified as being changed, and to indemnify Easyshopy for all material and moral losses if the user does not comply with the aforementioned articles, not to act in a way that interferes with other users' use of services, not to post, print, distribute, or circulate any immoral, inappropriate, or illegal information, not to advertise, sell, or offer to sell any products or services, not to participate in any survey, competition, or chain letter, not to send any unsolicited email, and not to harass or threaten other users or any Platform live chat staff.

The user is fully responsible for any damages, loss of information, or other losses caused by them in the user's computer. The user is not entitled to compensation for any losses resulting from the use of the service and is not permitted to use the services of the Platform for any commercial or promotional purposes without Easyshopy's prior approval. Easyshopy may continually or periodically watch over all systems.

The Platform may use its system for commercial purposes, but users are prohibited from sending any information that is unlawfully restricted and from disseminating any mail—such as chain letters, malicious software, etc.—that do not have permission to be sent. Users are also forbidden from recording and improperly using the personal information of others. The User is accountable for all types of acts carried out under the "username," and clients are required to pay the service fee that was previously disclosed at the time of delivery, not to use a third party's account or registration to access the Platform or use its services without the account holder's prior approval.

not to engage in any unlawful activity on the Platform or concerning any content on the Platform; not to engage in any commercial activity on the Platform other than that which is authorized by Easyshopy services; not to copy any content, including but not limited to Merchant menu content and third-party

reviews, for republishing in print or online; not to produce Merchant reviews or blog entries for or with any commercial or other profit-making endeavors.

Not to upload or transmit viruses or other harmful, disruptive or destructive files; and/or not to disrupt, interfere with, or otherwise harm or violate the security of the Platform, or any services, system resources, accounts, passwords, servers or networks connected to or accessible through the Platform or affiliated or linked Platforms (including those of our Merchant partners).

To use the Platform, all users must have their parent's or guardian's consent and be under their direct supervision if they are minors in the country in which they currently reside. Before using the Platform, if you are a minor, you must have your parent or legal guardian read and accept this Agreement. Cards used to place orders online through the Platform's payment gateway must belong to the user. If not, the user must first secure the cardholder's consent before proceeding with the transaction.

You must be the legal age required in your country to purchase Restricted Goods. Depending on the circumstances, either the Merchants or We may:

Ask for a valid proof of your age (e.g. ID card);
Refuse delivery if you are unable to prove you are of legal age;
To ask for a valid medical prescription (in the case of pharmaceuticals);
Refuse delivery to any person for any reason whatsoever. For Restricted Goods, there is no “contactless delivery”, “just drop them at the door delivery” or other similar delivery available.

User Material-

Any content you communicate or upload to this Platform will be regarded as non-confidential and non-proprietary, except for personally identifiable information ("Personal Data"), which is covered by the Platform's Privacy Policy. Regarding such material, the Platform will have no duties. The material and all data, images, sounds, text, and other items incorporated therein shall be free to copy, disclose, distribute, incorporate, and otherwise use for any commercial or non-commercial purposes by the Platform and anyone we designate.

It is against the law to post, upload, or transmit any content to or from this platform that:

violates any relevant local, state, federal, or international law;

is fraudulent or illegal.

entails unlicensed advertising; or

contains any malicious applications or viruses.

The Platform may not be abused by you (including by hacking).

Your Platform submissions of comments or feedback may not: Include any abusive, vulgar, or defamatory language;

Promote unlawful behavior or invade the privacy of another; encourage violence or discrimination; violate someone's intellectual property rights; give the idea that they come from us; or be used to impersonate someone else or falsely claim your association with someone else.

The forbidden behaviors mentioned in the sentences above are not all of them. If you violate any of these restrictions, you are responsible for paying Easyshopy's fees and damages.

Easyshopy will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or location of anyone posting any material in breach of the above paragraph.

Acceptable Use Policy-

You are not permitted to use the Platform for any other function than the one for which it is intended. Users may only use the Platform for their personal use; it may not be utilized in connection with any commercial activities unless those endeavors are expressly supported or allowed by the Platform. The company reserves the right to suspend, block, or terminate a user's Account and deny him access to the service if the user engages in any prohibited behavior. Activities that are prohibited include, but are not limited to, the following:

Violate any law, statute, ordinance or regulation
Violate applicable laws or industry regulations regarding the sale of alcoholic drinks or prescription drugs and devices
Violate the copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of the account owner's jurisdiction
Any illegal products, services or activities, including encouraging, promoting, facilitating or instructing others to engage in illegal activities
Payments to or from any listed sanctioned countries. Businesses or businesses with persons subject to international/national sanctions, suspected or convicted of terrorism, financial crime or any other offense
Providing false information relating to the customer's identity or business activities
Any product, service or activity that finances terrorism
Narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, products including THC, CBD or any other similar substance, any activity that relates to drug paraphernalia
Products, services or activities including media and journalism, that could be considered as being of a discriminatory, hateful, racist or exploitative nature, or of inciting harassment, bestiality, mutilation or violence
Connected to services where the service provider collects money on behalf of others as a payment services provider, cheque encashment agencies, foreign exchange providers, money transmitters, traveler's cheques or money orders
Involving ammunition, explosives, arms, defense or weapons, replica weapons, gun parts or related parts or accessories, hunting, manufacture/distribution of weapons
Services relating to hospitality timeshares or issuing of travel visas
Promotion or advertising of products or services other than your own without appropriate authorization
Collecting money without a license when compulsory in the account owner's jurisdiction
Multi-level marketing programs, network sales, matrix programs, outbound and inbound telemarketing or other similar programs including pyramid and Ponzi schemes
Gambling, betting activities, casinos, lotteries, sweepstakes, penny auctions, services related to fantasy sports or sports forecasting, or sale of value usable "chips" or vouchers connected to these services, certain in-purchasing games
Programs, materials or services related to get-rich courses or related to increasing your wealth or gambling
Factoring, lending, investment services, financial, escrow or mortgage services, pawn shops
Private business directories, businesses specializing in warning letters, liquidation or proxy services
Buying or selling stocks, bonds, securities, options, futures, binary options or investment interest in any entity or property, services related to raffles, debt consolidation, insurance brokers, payday lenders, medical collections, scholarship programs, payment protection insurance, currency exchange or FOREX activities
Modification chips (e.g. to modify a games console to use non-producer hardware or software)
Ticket agencies without a license, ticket resale
Replica clothes and products, or counterfeit goods
Objectionable, offensive, indecent, harassing, threatening, embarrassing, distressing, vulgar, hateful, racially, ethnically or sexually offensive, or otherwise inappropriate behavior towards the Easyshopy's personnel.
Highly rated politically exposed persons (PEP).

Easyshopy reserves the right but is not obligated to do any or all of the following (with no limitation to other actions):

investigate an allegation that any content posted on the Platform does not conform to these Terms and determine in its sole discretion to remove or request the removal of the content;
remove content that is abusive, illegal, or disruptive, or that otherwise fails to conform with these Terms;
monitor, edit, or disclose any content on the Platform; and
edit or delete any content posted on the Platform, regardless of whether such content violates these Terms.
cancel any Order and/or suspend, deactivate or terminate your Account in its sole discretion if it reasonably suspects or detects fraudulent behavior or activity associated with your Account and/or with your Order and/or any of the reasons named in section 4 of these Terms.

Authority of Easyshopy-

Easyshopy has the right to halt system operations altogether or temporarily. Due to the temporary suspension or complete termination of the system functioning, the Platform shall have no obligations to Easyshopy Users or any other parties.

The registered Users must see and approve the username and password. If Easyshopy determines it is necessary, it may prohibit its registered Users who have made accounts on the Platform from creating new passwords or from using their old passwords for an indeterminate length of time.

Easyshopy does not guarantee that its services will be delivered on time, completely, and securely or that they will produce accurate, dependable results.

Easyshopy reserves the right to backup and deletes all or a portion of the files and messages that Users provide while using the services for a length of time that the Platform deems appropriate. Back-up and deletion procedures are not Easyshopy's responsibility.

The ownership and copyrights resulting from the ownership of the data, files, software, designs, images, etc. that it creates or acquires from outside sources belonging to the Platform.

The meals of the businesses that are offered in Easyshopy are only available while supplies last. Any item ordered but not delivered by the Merchant as a result of availability is not Easyshopy's responsibility.

Easyshopy has the right to publish any content that is user-generated and uploaded to the platform by users, including messages, poems, reports/news, and files posted to the bulletin board, and/or to transmit it to another location within the platform that Easyshopy deems appropriate. Other people have likely copied and/or posted this data. Users must refrain from asking Easyshopy for royalty in such circumstances.

The companies with cyber-Merchants on the Platform are responsible for updating the information on prices and product specifications that are presented for sale in Easyshopy. In the case that there is any inaccurate information regarding the cost and features of products, Easyshopy may cancel the order to correct the mistake.

Guidelines for Reviews-

A User may switch to various Platforms via Easyshopy. In this situation, the User acknowledges that Easyshopy will not be held liable for the Platforms that the User may access using its Platform.

Easyshopy reserves the right to switch over time from services that don't require an account to ones that do. Easyshopy may offer extra services, modify some of the existing services in whole or in part, or turn them into a paid service.

This Platform might be down occasionally so that maintenance and upgrades can be done. Despite our best efforts, we cannot promise that Users will be informed in advance of any service interruptions, thus we reserve the right to change or discontinue the service at any time.

The following standards are used to approve reviews:

RELEVANCY

Reviewers must have first-hand knowledge of the Merchant.

APPROPRIATE CONTENT

Easyshopy is not required to consent to Platform evaluations. A selection of the possible grounds for rejection include:

Defamatory Language In our interactive parts, we do not accept language that is profane, abusive, racial, or hateful.

material that is irrelevant or non-indicative.

discrimination based on disability, age, marital status, race, gender, or national origin.

connections to unlawful conduct or references to social customs and ideals that are not linked.

Competing interests: Negative ratings cannot be posted by rival merchants. If this is broken, you could be banned from the Platform forever.

allegations of infractions of the health code.

outmoded and out-of-date information.

NOT ENDORSED

Reviews are not endorsed by Easyshopy and do not represent the views of Easyshopy, our parent companies or our subsidiaries. Easyshopy does not assume liability for any review or any claims, liabilities or losses resulting from any use of the Platform, or information on the Platform.

OWNED BY EASYSHOPY

Reviews are owned by Easyshopy exclusively in perpetuity. We have the right to reproduce, modify, translate, transmit, and/or distribute all materials relating to reviews. Easyshopy is under no obligation to pay the author or anyone else for their reviews.

Termination of Agreement-

Easyshopy has the right to terminate, suspend or delete your Account and your access to or use of the Platform, including any delivery service we provide to you in respect of an Order, for any reason, including, without limitation, if Easyshopy, in its sole discretion, considers your use to be unacceptable, or in the event of any breach by you of these Terms. Where appropriate, Easyshopy will allow you to state your position, before any termination, suspension or deletion of your account.

Restrictions for Non-Personal and Non-Commercial Use-

You agree that the consequences of commercial use or re-publication of content or information of Easyshopy may lead to serious and incalculable monetary compensation that may not be a sufficient or appropriate remedy and that Easyshopy will be entitled to temporary and permanent injunctive relief to prohibit such use.

Refund Policy-

Easyshopy takes user satisfaction very seriously. In the case of problems with your goods and services order, please contact Easyshopy through our live chat and we will assist you. In appropriate cases, if you have already been billed by Easyshopy on behalf of the Merchant, Easyshopy will issue full or partial refunds. In the following cases: if you did not receive your order or did not receive your order, you may be issued a full refund; if part of your order is missing, we may issue a partial refund. In every event, we will take into account relevant factors including the details of the order and do our best to ensure your satisfaction. You will receive your refund as Easyshopy credit on your Easyshopy account unless you request a refund to the original source of payment.

Price and Payment-

Once your order has been accepted, this represents an agreement between you the User and the Merchant. The Merchant has sole responsibility for this order. Cash payments are made directly to the Merchant upon delivery to fulfill the order.

Easyshopy does not provide any payment service either to you or to third parties. All online payments are processed via your own issuer/payment service provider and the payment service providers in partnership with Easyshopy.

Prices quoted on the Platform shall be displayed in the applicable country's national currency and subject to applicable tax. You accept that prices and offers on the Platform may vary from the prices and offers offered by our Merchants elsewhere (including their websites, mobile applications, or at their brick-and-mortar outlets).

Depending on the Merchant and, as long as applicable regulations are followed, the prices represented on our Platform, we may display the prices of our goods in a variety of ways. Prices and other fees (such as Delivery, Small Basket, or Service fees, among others) listed on the Platform are accurate as of the time of each Order, but they are liable to change at any time. Easyshopy retains the right to impose fees for our services as we think essential for our business, including but not limited to Delivery, Small Order, or Service fees. Payment Procedures

You have a variety of payment options accessible to you when using your Account as a payment instrument, as available and displayed on the Platform.

Easyshopy retains the right to introduce new payment options and/or discontinue accepted ones at any time and for any reason. If you decide to pay online, our third-party payment service provider will handle processing the payment (s). Your credit card or other payment information will be saved by our third-party payment service provider(s) for use on subsequent Orders with your permission. Your credit card number or other payment information is not saved by Easyshopy.

You must make sure you have enough money on your credit and debit cards to complete an Order's payment. Easyshopy assumes responsibility for payments made on our Platform, including refunds, chargebacks, cancellations, and dispute resolution, as necessary and in line with these Terms and other reasonable and fair conditions.

Before using any payment method, please carefully read the relevant payment conditions referenced and disclaimers at the time of checkout.

Rider Tips-

All orders, except orders for cash-on-delivery and items delivered by the Merchant, are subject to the Rider Tip (as described above). You have the choice to tip the rider who will deliver your order when you make an order on the platform ("Rider Tip"). The payment method you selected for the order will be used by Easyshopy to collect payment for the Rider Tip. Once the delivery is complete, the rider will get the entire amount of any Rider Tips you decide to leave.

If a purchase is canceled before delivery, Easyshopy will reimburse any Rider Tips you have already paid either as Easyshopy credit in your Easyshopy account or using the original payment method you specified.

Once the rider has delivered the order, rider tips are not returnable.

Validity of Easyshopy records-

This article has the characteristics of an evidential contract, and the User waives in advance any objections to the specified Easyshopy records and the right to tender an oath about the fact that these records are kept in dissent. The User further agrees, states, and warrants that any bookkeeping entry, microfilm, microfiche, and computer records constitute valid, binding, absolute, and exclusive evidence in the disputes that may arise about their Terms.

Governing law and competent-

These Terms shall be governed by and construed by the laws of the United Arab Emirates. Disputes arising in connection with these Platform Terms (including non-contractual disputes) shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

Severability-

If any portion of these Terms is found to be unlawful, void, or for any other reason unenforceable, then that provision shall be deemed severable from these Terms and shall not interfere with the validity and enforceability of any other portion of these Terms. No waiver by Us shall be deemed a waiver of any breach of any clause which may have occurred before or after such waiver.

License-

By these Terms and only for your own private, non-commercial use, Easyshopy hereby grants you permission (which may be revoked at any time for any reason or no reason) to view the Platform and to download, email, share via social networking, or print specific pages from the Platform, provided that you do not remove any trademark, copyright, or other notice contained on such pages. Other uses are not allowed.

For instance, you are not permitted to include the data, content, or other materials in any compilation, archive, or cache. Any information, content, material, software, products, or services accessed through the Platform may not be modified, copied, distributed, republished, transmitted, displayed, performed, reproduced, published, reused, resold, licensed, transformed into another work, transferred, or sold. Except as specifically authorized by Easyshopy.

To scrape, copy, or monitor any part of the Platform or any information, content, or material on the Platform, you are not permitted to deep-link to the Platform for any reason. Neither are you permitted to access the Platform manually or using any robot, spider, web crawler, extraction software, automated process, or device. Easyshopy reserves all of its legal and equitable remedies against anybody or anything that disobeys this clause. Without Easyshopy's prior written authorization, you are not permitted to link to or frame any Platform pages or any of the content that appears on them, either in full or in part. Through social networking technology mentioned on the Platform, you can "like" the Platform or share links to it. Any rights that aren't expressly granted in this clause are reserved.

Intellectual Property Rights-

Easyshopy and/or third parties who have permitted us to use their trademarks, logos, images, and service marks, as well as these Terms as they are shown on the Platform or in our marketing materials, are the owners of all such intellectual property (collectively the "Intellectual Property"). This Intellectual Property may not be used, copied, reproduced, republished, uploaded, posted, transmitted, distributed, or modified in any way without our prior express written authorization. It is completely forbidden to utilize any of our intellectual property, including but not limited to Easyshopy trademarks and copyrights to the Easyshopy logo, on any other website that has not received our approval. Easyshopy will vigorously protect its intellectual property rights by prosecuting violators to the fullest extent of the law. Easyshopy neither guarantees nor claims that your use of the materials on the Platform won't violate any third-party rights or otherwise constitute a theft from parties other than Easyshopy or its Affiliates. You use all Platform content at your own risk.

Contribution License-

You automatically grant Easyshopy an irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully paid, worldwide license to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part), and distribute your contributions by posting them to any part of the Platform. You also represent and warrant that you have the right to grant this license.

In our sole and absolute discretion, Easyshopy has the right to-

Edit, redact or otherwise change any contributions,
Re-categorize any contributions to place them in more appropriate locations or
Pre-screen or delete any contributions that are determined to be inappropriate or otherwise in violation of this Agreement.

Links to and from other platforms-

The Platform may include links to other websites or applications as a favor to you. Some of these websites/apps might be connected to Easyshopy, while others might not be. Any website/application pages generated and managed by businesses other than Easyshopy are not the responsibility of Easyshopy. You do so at your own risk while accessing any such third-party websites or application pages. The accuracy, completeness, or timeliness of the material on these third-party internet pages cannot be guaranteed by Easyshopy because it has no control over those pages' content. You use such information at your discretion, and you should only rely on it after conducting an independent review. Any mentions of commercial goods or services on such third-party website pages do not signify or imply Easyshopy's support of them.

Prescription Medicine-

You must be 18 years of age or older to order prescription medication from our platform. You consent to share your ID, prescription information, and health insurance details. This information will be shared right away with the pharmacy so they can complete your order in compliance with our Privacy Policy and validate your ID and prescription. Please be aware that Easyshopy will not have any access to or view any provided information. Your order can be declined if your ID or prescription is inconsistent. You acknowledge that the pharmacy is the only party in charge of the prescription medication and that you must direct any concerns or complaints about it to the pharmacist.

On the pharmacy's invoice that the pharmacy will send in the prescription bag, you may find information about the pharmacy, including the name of the pharmacy as it appears on the DHA/DOH license, the name of the pharmacy manager or pharmacist-in-charge, the names of the licensed pharmacists providing the services, the physical location of the pharmacy(s), and telephone number(s).

Please be aware that it is illegal to have prescriptions written outside of the United Arab Emirates.

Only you, or a representative you designate who is at least 18 years old, may get prescription medication on your behalf. If the ID is incorrect, we reserve the right to reject delivery.

Before using a medication, we suggest speaking with your doctor or the pharmacy for any information on its proper use and dose. You are aware that Easyshopy merely serves as a delivery partner and is not a pharmacy.

Limitation of Liability-

To the fullest extent permitted by law, Easyshopy provides this Platform and its content on an "as is" and "as available" basis. Easyshopy makes no express or implied representations or warranties regarding the content or availability of this Platform, that it will be timely or error-free, that defects will be fixed, or that the Platform or server that makes it available is free of viruses or other potentially harmful elements. Subject to the preceding sentence, neither Easyshopy nor any of its directors, officers, agents, employees, or contractors shall be liable for any direct, indirect, special, or consequential losses or damages (including, without limitation, losses in business or profits), resulting from the use or inability to use the platform.

The preparation, state, and caliber of the goods that are sold to you are completely the merchants' responsibility. When a merchant delivers a product or an order, the merchant is in charge of that delivery. Any loss, damage, expense, cost, or fee resulting from your contractual relationship with the Merchant shall not be the responsibility or liability of Easyshopy.

Indemnity-

You consent to defend, hold harmless, and indemnify Easyshopy, its parents, subsidiaries, affiliates, agents, officers, directors, and other staff members from any claim, demand, or damage (whether direct, indirect, or consequential), including reasonable attorneys' fees, made by anyone in connection with your use of the Platform, your submissions, with any alleged infringement of an individual's or entity's intellectual property or other right related to the Platform, your violation of any law, or otherwise.

Amendments-

Subject to any applicable laws, Easyshopy reserves the right to modify these Terms at any time and its sole discretion. The modified Terms will take effect as soon as they are posted. You must often review the Terms. You must discontinue using the Platform and/or any of its services right once if you do not agree with the modified Terms, in whole or in part.

Disclaimer-

Whether provided by Easyshopy, you, other users, or other affiliates/third parties, the information, content, products, services, and materials made available through the application (including without limitation, orders for goods and services, submissions, text, photos, graphics, audio files, video, and links) are provided "as is" and "as available" without any express or implied warranties. Easyshopy disclaims all representations and warranties, express or implied, to the fullest extent permitted by law, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, lack of computer virus, and implied warranties resulting from a course of dealing or course of performance.

Prevailing Language-

These terms shall be available in both English and Arabic. In case of any discrepancies between the two versions, the English version shall prevail.
